Warranty claims
All claims must be submitted on a Warranty Return Request Form, and all warranty claims must be submitted to Mobilya, LLC in writing within thirty (30) days of discovery of the defect, but in no event later than ninety (90) days after expiration of the applicable warranty period, or such claims are forever waived. The Purchasing Entity's failure to submit claims within these time periods shall constitute a waiver of warranty rights for the specific defect claimed. Time is of the essence with respect to all warranty claim deadlines. Mobilya, LLC reserves the right to deny any claims submitted outside these prescribed time periods.
Any and all work performed by any third parties related to any issues stated in a warranty claim must be pre-approved in writing by Mobilya, LLC. On all approved warranty claims received within the warranty period, Mobilya, LLC will pay for 100% of all approved required costs for shipping and Mobilya, LLC parts. As stated in Mobilya, LLC's Terms and Conditions and Order Confirmation, Mobilya, LLC relies on the Purchasing Entity for local support, service calls, and labor related to warranty. All approvals must be in writing executed by an officer of Mobilya, LLC. In the event a return is determined to be a non-warranty claim, the Purchasing Entity shall be responsible for all shipping charges, evaluation costs, and any other associated expenses incurred by Mobilya, LLC. Mobilya, LLC shall have no obligation to bear any costs related to non-warranty claims, and the Purchasing Entity shall provide reasonable documentation to support warranty eligibility.
Warranty
The following outlines the warranties for Mobilya, LLC's Products ("Warranties"). These Warranties are extended solely to the original Purchasing Entity and are non-transferable under any circumstances. The Warranties become effective only upon: (i) full payment for the products purchased from Mobilya, LLC; (ii) delivery of such products to the location specified in the final Order Confirmation; (iii) proper installation strictly in accordance with Mobilya, LLC's provided specifications; and (iv) reading, understanding, and following Mobilya, LLC's Use and Care Handbook (provided via email upon request of final payment). Valid proof of purchase is required. The Warranties shall be immediately void if any damage results from: (a) improper use; (b) improper installation; (c) failure to follow Mobilya, LLC's specifications; or (d) any modification or alteration not expressly authorized by Mobilya, LLC in writing.
Only upholstery options designated as healthcare-approved on Mobilya, LLC's current upholstery specification sheet are warranted for use in clinical environments, including without limitation infusion centers, dialysis centers, hospital patient rooms, and NICUs. The use of non-healthcare-approved upholstery in clinical environments voids all warranty coverage related to the upholstery. It is the sole responsibility of the Purchasing Entity to verify that the selected upholstery is appropriate for the intended environment prior to order placement. Frame
Mobilya, LLC warrants that the frame construction is free from defects in material and workmanship for a period of 5 years from the date of purchase under normal use and wear. This warranty is non-transferable and requires valid proof of purchase. Proper installation and use strictly according to Mobilya, LLC's specifications are required for this warranty to apply. This warranty will be void if damage results from improper use, improper installation, or failure to follow Mobilya, LLC's specifications.
Metal mechanisms
Motorized and adjustable seating products are built of moving parts (the "Mechanisms"). The Mechanisms inherently have a certain degree of slack to accommodate individual user adjustments and movements, to ensure they remain protected from damage or bending. Therefore, there might be small variances in footrest, seat, and backrest positions when in any open or closed position. These variances might be aggravated by other variables such as the type of upholstery used (e.g. thickness, structure, fastness to rubbing) and the weight or height of the person seated, therefore causing the seats and their position to appear inconsistent with each other. Mechanisms require settling of components and, over time, components will settle into the correct position for the mechanism based on its use.
Subject to the foregoing disclaimer and all other limitations herein, Mobilya, LLC warrants against the failure of any and all mechanisms made exclusively from metal for three (3) years from the date of delivery, provided that such mechanisms are used only under normal use conditions in accordance with Mobilya, LLC's specifications. The mechanism warranty covers only replacement parts. Labor, service fees, and any and all delivery fees associated with any repairs are not the responsibility of Mobilya, LLC. All warranty claims must be submitted on a Warranty Return Request Form and must be accompanied by pictures. Mobilya, LLC shall have no obligation to bear any costs related to non-warranty claims, and the Purchasing Entity shall bear the burden of proving warranty eligibility with clear and convincing evidence.
Upholstery
Mobilya, LLC warrants leather and fabric against defects in materials and workmanship under normal use and, at its sole discretion, Mobilya, LLC shall provide replacement according to the following schedule, calculated from the original date of delivery at address as specified in the signed Order Confirmation:

This warranty shall be void if damage results from: (a) improper use; (b) abuse; (c) improper installation; or (d) failure to follow Mobilya, LLC's care instructions. The Purchasing Entity must provide documentation demonstrating warranty eligibility. This warranty does not apply to customer-owned or provided materials (COL/COM). Where third-party upholstery manufacturers provide their own separate warranty (such as the Crypton 5-year fabric warranty), that manufacturer's warranty applies independently and does not extend or modify Mobilya, LLC's warranty obligations.
Stitching
Mobilya, LLC warrants that all stitching shall be free from defects in materials and workmanship, including but not limited to tearing or separating from the leather or fabric, under normal use conditions and provided the Product has been properly installed and maintained according to Mobilya, LLC's specifications. Subject to proper claim submission within the warranty period and Mobilya, LLC's reasonable discretion in determining whether repair or replacement is appropriate, Mobilya, LLC shall provide replacement according to the following coverage schedule, calculated from the original date of delivery at address as specified in the signed Order Confirmation:

This warranty applies only to the original Purchasing Entity and is non-transferable. Mobilya, LLC reserves the right to deny coverage if damage results from improper use, installation, maintenance, or unauthorized modifications.
Electronic motors and electrical parts/systems
Mobilya, LLC warrants its electric motors and electric parts/systems for a period of three (3) years from the date of delivery at address as specified in the signed Order Confirmation against defects in materials and workmanship under normal use. Should such parts fail during the warranty period, Mobilya, LLC shall provide replacement parts for the defective components, at Mobilya, LLC's sole discretion, provided that: (i) the defect is reported within thirty (30) days of discovery; (ii) the parts were properly installed in accordance with Mobilya, LLC's specifications; and (iii) the failure did not result from misuse, accidents, unauthorized modifications, or failure to follow Mobilya, LLC's specifications. The Purchasing Entity must provide reasonable documentation demonstrating warranty eligibility, including proof of purchase, installation records, and evidence of the claimed defect.
Warranty limitations
Materials and leathers provided by customers or Purchasing Entity (COM/COL) for use as upholstery on Mobilya, LLC chairs are expressly excluded from warranty coverage related to the upholstery aspect of Mobilya, LLC warranty, express or implied. Mobilya, LLC waives liability for defects, damage, or performance issues related to or arising from customer-provided materials. The Purchasing Entity acknowledges and accepts all risks associated with the use of customer-provided materials.
The Parties acknowledge and agree that natural differences, variations and irregularities in the leather, fabric, wood, metal finishes, colors, grains, textures and other cosmetic aspects of the Products are inherent characteristics of natural and manufactured materials, are within commercially reasonable manufacturing tolerances, and shall not be deemed defects or non-conformities under this warranty.
The following are excluded from warranty coverage:
- Damage caused by use of the items or goods for any purpose other than their intended use and design specifications. This includes but is not limited to modifications or installations that deviate from Mobilya, LLC's specifications.
- Damage to items or goods caused by disaster such as fire, flood, or extreme weather events.
- Damage resulting from the neglect, abuse, or misuse of items or goods, including vandalism or damages or non-conformities caused by any further processing or handling of goods by the Purchasing Entity or by the end user.
This warranty applies only to normal use conditions. No warranty coverage applies to damage resulting from misuse, abuse, or use contrary to provided instructions. All warranty claims must include proof of purchase and are subject to inspection by Mobilya, LLC or its authorized representatives. Mobilya, LLC's warranty does not include damage from normal wear and tear such as dents, nicks, scratches, fading, misuse, or improper maintenance. Damage caused by ultraviolet light, water, or extreme changes of temperature are specifically excluded from warranty. Mobilya, LLC's warranty does not include damage caused by pets, chemical spills, cuts, burns, body fluids, body oils, or other conditions deemed to be abnormal usage. Upholstery does require proper care to ensure long life of the product. For maintenance or cleaning, use only products appropriate for the specific upholstery type as specified in Mobilya, LLC's care instructions. Certain upholstery types should be cleaned and conditioned at least once every six months. Other products used on upholstery may void the upholstery warranty. One should expect the cushioning and foam to become softer over time. The warranty excludes normal softening of polyurethane foam cushioning and padding material around the foam.
For upholstery designated as healthcare-approved, the applicable Mobilya, LLC-provided care instructions specify cleaning agents and protocols appropriate for clinical settings, including hospital-grade disinfectants where compatible with the specific upholstery. Damage resulting from the use of cleaning agents in accordance with Mobilya, LLC's care instructions for the specific upholstery type shall not void this warranty. Damage resulting from the use of cleaning agents not approved for the specific upholstery type, or from failure to clean promptly following exposure, remains excluded from warranty coverage regardless of the environment in which the product is used.
NO OTHER WARRANTY OTHER THAN THAT STATED ABOVE IS GRANTED HEREIN BY MOBILYA, LLC. IN NO EVENT WILL MOBILYA, LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR REPRESENTATIVES BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR INDIRECT DAMAGES, WHETHER IN CONTRACT, TORT, OR STRICT LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND FURTHER INCLUDING ANY POTENTIAL CLAIMS FOR LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER ECONOMIC LOSS, REGARDLESS OF THE FORM OF ACTION OR LEGAL THEORY. EXCEPT FOR THE EXPRESS WARRANTY STATED IN THIS SCHEDULE, MOBILYA, LLC GRANTS NO WARRANTIES, EITHER EXPRESS OR IMPLIED HEREIN, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND THIS STATED EXPRESS WARRANTY IS IN LIEU OF ALL LIABILITIES OR OBLIGATIONS OF MOBILYA, LLC FOR DAMAGES INCLUDING BUT NOT LIMITED TO, CONSEQUENTIAL DAMAGES OCCURRING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF ANY GOODS SOLD HEREUNDER.
ADDITIONALLY, MOBILYA, LLC WILL NOT BE LIABLE, WITH RESPECT TO ANY PRODUCT SOLD OR OFFERED BY MOBILYA, LLC OR WITH RESPECT TO ANY ASPECT OF MOBILYA, LLC'S BUSINESS UNDER ANY CONTRACT, THEORY OF NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS, SERVICES, TECHNOLOGY OR RIGHTS OR FOR ANY AMOUNTS AGGREGATING IN EXCESS OF THE PRICE OF ANY PRODUCT OR PRODUCTS ORDERED AND PAID FOR BY THE PURCHASING ENTITY. THE MAXIMUM LIABILITY, IF ANY, ARISING FROM ANY PRODUCT SOLD BY MOBILYA, LLC SHALL BE THE PRICE OF THE PRODUCT OR PRODUCTS ORDERED AND PAID FOR BY THE PURCHASING ENTITY. IN NO EVENT SHALL MOBILYA, LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR REPRESENTATIVES BE LIABLE UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR PUNITIVE DAMAGES RELATED TO ANY PRODUCT SOLD OR OFFERED BY MOBILYA, LLC OR RELATED IN ANY WAY TO ITS BUSINESS. THE TOTAL CUMULATIVE LIABILITY OF MOBILYA, LLC SHALL NOT EXCEED THE PURCHASE PRICE OF THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
The Limited and General Warranties are intended solely and exclusively for the benefit of Mobilya, LLC and the original Purchasing Entity that purchased the Products directly from Mobilya, LLC. No person or entity other than such original Purchasing Entity shall be deemed a third-party beneficiary of these warranties or have any right to enforce any provision hereof. These warranties do not create or imply any rights in favor of subsequent purchasers, end users, lessees, installers, dealers, distributors, or any other third parties. Any attempted transfer, assignment, delegation, or enforcement of warranty rights by any third party shall be void ab initio and of no legal effect. The original Purchasing Entity shall indemnify and hold Mobilya, LLC harmless from any claims, losses, damages, or expenses arising from or related to any attempted third-party enforcement of these warranties.
